Future Donations/Tax Credits under Alabama
Accountability Act Suspended
Montgomery—Effective
May 28, 2014, the Alabama of Department of Revenue has disabled the online
portal that allows taxpayers to donate to Scholarship Granting Organizations
and reserve an Alabama tax credit under the Alabama Accountability Act.
This action was taken as result of the May 28, 2014, ruling in the Circuit
Court of Montgomery County, Alabama, Dr. Daniel Boyd et al v. Julie P. Magee
et al, Case No. 03-CV-2013-901470.00.
A copy of the court order may be found
on the Department of Revenue’s website.
The court order applies prospectively,
meaning that any tax credits under Section 8 for expenditures with respect to
the 2013-2014 school year, and tax credits under Section 9 with respect to
donations made prior to the date of this order will be allowed.
Any questions concerning future legal
action should be directed to the State Attorney General’s Office.
