This is a reminder to all candidates for
state office and their principal campaign committees that pursuant to Alabama
Code § 17-5-7 (b) (2), they may not accept, solicit, or receive contributions as of 12:01
AM on January 12th due to the start of the 2010 Regular Legislative
Session. (See Ala. Att’y. Gen. Op.
No. 94-00228)
At that time, please discontinue all your
fundraising efforts, including those on your campaign websites.
State office is defined as “all offices under
the constitution and laws of the state filled by election of the registered
voters of the state or of any circuit or district and shall include legislative
offices.” Alabama Code §17-5-2 (a) (15). Please note that this does not include
candidates involved in a special election.
Fundraising efforts may resume beginning February 1, 2010 as Alabama Code § 17-5-7 (b) (2) indicates that the
blackout period does not apply within 120 days of any primary, run off, or
general election.
