Request for Public Comment re: Community Waiver Program (CWP) Amendment


Pursuant to 42 CFR 441.304(f), the Alabama Medicaid Agency (Medicaid) is required to give public notice of its intent to submit a proposed Community Waiver Program (CWP) amendment to the Centers for Medicare and Medicaid Services (CMS). The CWP provides Home and Community-Based Services (HCBS) to individuals (ages 3+) who, but for the provision of such services, would require Intermediate Care Facility for Individuals with Intellectual Disabilities (ICF/IID) level of care as defined in 42 CFR §440.150. This request to amend the specified Waiver will not have a negative impact on Medicaid recipients.

The purpose of this amendment is to:

  • Revise the unduplicated count of waiver participants for Waiver Year 5 to reflect actual waiver enrollments and updates to resources the State has available to further expand capacity;
  • Increase reserve capacity to reflect increased need for reserve slots for outplacements from nursing homes and other institutions, emergencies and children in state custody;
  • Change the total number of contracted Financial Management Services Agencies (FMSAs) for self-direction from two to one;
  • Update numerical figures for Waiver Year 5 to reflect the revised unduplicated count.
As required by federal regulation, Medicaid will open a formal thirty (30) day comment period and interested parties are directed to: https://medicaid.alabama.gov/content/6.0_LTC_Waivers/6.1_HCBS_Waivers/6.1.9_Community_Waiver_Program.aspx.

The thirty (30) day public comment period will begin on August 15, 2026 and conclude on September 15, 2026, at 5:00 p.m. CST. Comment letters must be postmarked by the conclusion date to be accepted. Written comments concerning these changes should be emailed to:
